Golpe do “falso advogado”: como vítimas que aguardam indenização estão sendo enganadas.

O advogado e perito em crimes cibernéticos Dr. José Milagre participou da reportagem exibida no Fantástico e do episódio especial do podcast Isso é Fantástico, explicando como funciona o golpe e quais medidas adotar para se proteger.

O programa Fantástico, da TV Globo, exibiu neste domingo (27/10), uma reportagem especial sobre o chamado “golpe do falso advogado”, um esquema criminoso em que golpistas se passam por advogados ou representantes jurídicos para enganar pessoas que aguardam o recebimento de indenizações ou valores de ações judiciais.

Além da matéria televisionada, o tema foi aprofundado no podcast “Isso é Fantástico”, apresentado por Renata Capucci, com reportagem de Giovanni Grizotti. O advogado e perito em crimes cibernéticos Dr. José Milagre, especialista em Direito Digital e fundador da CyberExperts, foi um dos entrevistados, trazendo uma análise técnica sobre o golpe e as formas de prevenção.

O episódio aborda um esquema no qual criminosos se passam por advogados ou representantes jurídicos, prometem indenizações ou acordos extrajudiciais às vítimas que já estão à espera desses valores e acabam se aproveitando da situação vulnerável para extorquir, coletar dados ou cobrar valores de forma indevida.

Durante a conversa, foram destacados alguns sinais comuns desse tipo de golpe:

  • contato inicial de “advogado” que afirma já ter ganhos ou mandato, e pede “confirmação” de dados pessoais ou pagamento adiantado;
  • promessa de solução rápida ou “acordo certo” para obtenção de indenização, mesmo quando o processo ainda está longe de ser concluído;
  • exigência de dados, senhas, ou antecipação de custas ou “taxas administrativas” para liberação de valores;
  • pouca ou nenhuma possibilidade de verificação do profissional ou escritório (“apenas WhatsApp/Telegram”, registro duvidoso, ausência de OAB verificada).

O episódio também traz orientações essenciais para quem está nessa situação ou pode vir a estar:

  • verificar sempre o registro e histórico do advogado ou escritório, por exemplo, junto à Ordem dos Advogados do Brasil (OAB);
  • desconfiar de solicitações de pagamento antecipado ou “taxa de promessa” para liberação de valores;
  • investir em segurança de dados pessoais, senhas, documentos; evitar compartilhamento salvo com profissionais confiáveis e identificados;
  • procurar assessoria jurídica ou contatar órgãos de defesa do consumidor, polícia civil ou delegacias especializadas em crimes cibernéticos / fraudes;
  • ter paciência e checar o andamento processual: indenizações não costumam ser pagas de forma “instantânea” ou sem trâmite formal.

Para o escritório, que atua em casos de crimes cibernéticos, segurança digital, proteção de dados e compliance em IA, este episódio reforça a necessidade de atenção redobrada à fraude digital, à atuação de “profissionais fantasmas” no meio jurídico-financeiro e ao dever de orientação preventiva aos clientes.
